Privacy Policy for Harper MD, LLC. (Operating under the name “HARPER MD”)
This Privacy Policy does not govern the information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (HIPAA). That information falls under our HIPAA Notice of Privacy Practices.
Introduction
Harper MD, LLC (“HarperMD,” “we,” or “us”) owns and operates the website found at www.HarperMD.com and an associated mobile application (together, the “Platform”). Your use of any aspect of the Platform, including its content (“Content”), any products or services provided by Harper MD, and any affiliated website, software, or application owned or operated by Harper MD (collectively referred to as the “Service”), is subject to this Privacy Policy.
As part of the Service, Harper MD collaborates with various medical groups (referred to collectively as the “Medical Groups”) to offer online telehealth medical consultations and secure messaging between providers and patients. Consequently, our Service includes the professional medical services provided to you by the Medical Groups and their providers, and your use of these services is governed by this Privacy Policy. All mentions of “we” or “us” in this Privacy Policy also include the Medical Groups and their providers.
We are dedicated to upholding the privacy of Service users. We have crafted this Privacy Policy (“Privacy Policy”) to detail how Harper MD collects, uses, and discloses information to deliver the Service to you.
By creating, registering, or logging into an account through the Service, or by otherwise accessing or using the Service, you automatically accept and acknowledge the most recent version of this Privacy Policy. Should any changes be made to our Privacy Policy, we will publish the updated version and revise the “Last updated” date accordingly.
If you are utilizing the Service on behalf of an individual other than yourself, you affirm that you are authorized by said individual to act on their behalf and that such individual accepts and acknowledges the practices and policies outlined in this Privacy Policy.
Capitalized terms not explicitly defined in this Privacy Policy carry the same meaning as set forth in Harper MD’s Terms and Conditions (“Terms and Conditions”).
Use Restricted to the US
The Service is intended solely for use within the US. This Privacy Policy, as well as our collection, use, and disclosure of your information, is governed by US law.
Use by Minors Prohibited
Our Service is designed for use by individuals who are at least 18 years old, or older as required by applicable state laws in the jurisdiction where the Service is utilized. The Service is not intended for individuals under 18 years of age. Should we become aware that we have collected personal information from a minor through the Platform, we may remove that information from the Platform. If you are a minor (or a parent or legal guardian of a minor), you may request the removal of personal information about the minor by submitting a Request for Removal of Minor Information to either of the following:
By mail: Harper MD, LLC, Attn: Privacy Officer, 3400 Lakeside Drive, Suite 515, Miramar, FL 33027, with the subject line “Removal of Minor Information”. If sending by mail, please use U.S. Certified Mail, Return Receipt Requested, for confirmation of mailing, delivery, and tracking.
For each Request for Removal of Minor Information, please indicate “Removal of Minor Information” in the email or letter subject line, and clearly provide the following in the body of the request:
The nature of your request
The identity of the information to be removed
The location of the information on the Platform (e.g., by providing the URL)
Your name, street address, city, state, zip code, email address, and whether you prefer to receive a response to your request by mail or email.
We will not accept any Request for Removal of Minor Information via telephone or fax. Harper MD is not liable for failing to comply with any incomplete, incorrectly labeled, or improperly sent Request for Removal of Minor Information.
Please note that we are not obligated to erase or otherwise eliminate, or facilitate the erasure or elimination of such information in certain circumstances, such as when international, federal, state, or local law, rule, or regulation necessitates Harper MD to retain the information; when Harper MD retains the information on behalf of your Providers (as defined in our Terms and Conditions) as part of your electronic medical record; when the information is stored on or posted to the Site by a third party other than you (including any information posted by you that was stored, republished, or reposted by the third party); when Harper MD anonymizes the information, rendering you unidentifiable; when you fail to adhere to these instructions for requesting information removal; and when you have received compensation or other consideration for providing the information.
This section outlines Harper MD’s voluntary practices concerning the inadvertent collection of personal information from minors through the Service and is not an acknowledgment that Harper MD is subject to the Children’s Online Privacy Protection Act, the Federal Trade Commission’s Children’s Online Privacy Protection Rule(s), or any similar international, federal, state, or local laws, rules, or regulations.

We collect any information you furnish when using the Service, including but not limited to:
- Personally identifying information like your name and contact details such as your email address, phone number, and billing and physical addresses
- Your login credentials and other account registration details
- Demographic data (e.g., gender, date of birth, zip code)
- Computer, mobile device, and/or browser information (e.g., IP address, mobile device ID information, operating system, connection speed, bandwidth, browser type, referring/exiting web pages, web page requests, cookie information, hardware attributes, software attributes)
- Information from third-party websites, networks, platforms, servers, and/or applications (e.g., Facebook, Twitter, Instagram)
- Usage activity concerning your interactions with the Service and/or third-party websites, networks, or applications accessed through the Service (e.g., viewing habits, preferences, history, clicks on a page or feature, time spent on a page or feature, identity of third-party websites, networks, etc.)
- Billing, payment, and shipping information
- Electronic signatures
- Photographic or video images submitted for identification or non-diagnostic or non-treatment purposes
- Information about third parties referred to us (e.g., name, email, and/or other contact information, relationship)
- Statements or content (e.g., comments, videos, photographs, images) and information about such statements or content, which you submit or publish on or through the Service or accessed via your public or linked social media pages (e.g., Facebook, Twitter, Instagram)
Any other information provided when you contact or communicate with us
If you utilize your mobile device to access the Service, additional categories of information we collect may include:
- Your name linked with your mobile device
- Your mobile device’s associated telephone number
- Your geolocation
- Your mobile device’s ID information
- With your explicit consent, your contacts and/or their contact information (e.g., names, telephone numbers, physical addresses, email addresses, photos) stored on your mobile device
- With your explicit consent, information about third-party software applications on your mobile device (including, without limitation, general software apps, downloadable software apps, social media apps)
- We also collect information on behalf of your providers, which may encompass but is not limited to:
- Health and medical data you provide for diagnosis or treatment purposes, including information in any questionnaires or surveys you complete for these purposes
- Details about previous doctors or other healthcare providers you visited
- Visit dates
- Images or videos you share for diagnosis or treatment purposes
Communications with providers
How Information Is Collected?
Harper MD may collect information directly from you when you use the Service, register with or subscribe to the Service, obtain any products or services available through the Service, “sign in,” “log in,” or interact with the Service through your computer, mobile device, or any other device, or when Harper MD requests such information. Additionally, if you or a third party sends Harper MD a comment, message, or other communication about you or your activities on or through the Site and/or the App, Harper MD may collect any provided information.
In addition to directly collected information, we may also obtain certain information from providers who offer treatment or other services to you in connection with the Service. This information may include, but is not limited to, diagnoses, treatment plans (including prescription details), and notes.
Furthermore, we may receive information from third parties that cover your care or provide you with treatment, laboratory care, or prescription medication, which may encompass, for instance, your prescription history, insurance policy, insurance eligibility and coverage, and laboratory test results.
Use of Information
Harper MD may utilize various tracking, data aggregation, and/or data analysis technologies, including, but not limited to, the following:
Cookies: Small data files (e.g., text files) stored on the browser or device used to view a website or message. They may assist in storing user preferences and activity, allowing a website to recognize a particular browser or device. Types of cookies include browser cookies, session cookies, and persistent cookies. Cookies may record information accessed on one page of a website to simplify subsequent interaction, or to streamline transactions. Scripts: Code pieces embedded in a website to define its response to certain user actions. Scripts may collect information about user interactions, like clicked links. They are often temporarily downloaded to the user’s device from the website server, active only while the user is connected, and deactivated or deleted when the user disconnects.
Analytic Tools and Services: Services offered by third parties to track, measure, and/or generate information about a website’s or program’s traffic, sales, audience, and similar details. These tools may be used for statistical research, marketing research, content ratings research, and conversion tracking.
Advertising Services: Data on browsing and shopping behavior may be used to display relevant interest-based ads from us or our advertising partners. Cookies and other information may provide relevant interest-based advertising, with ad networks using browsing activity across participating websites to present tailored ads. Interest-based ads are shown based on browsing behavior to offer more personalized advertisements. These ads may appear while browsing the Platform or third-party sites not owned by us. Currently, we do not recognize “do not track” signals from browsers or similar mechanisms indicating a desire not to be tracked or receive interest-based ads. Examples of analytic tools, services, and advertising services we use include:
Meta Platforms: We employ Meta platforms, like Facebook and Instagram, for web analytics and advertising services. These services track user actions post-viewing or post-clicking on a Meta advertisement, track users accessing our Platform or advertisements from different devices, and offer better-targeted advertisements to our intended audiences. Meta data is stored and processed by Meta, which can connect this data with your Facebook or Instagram account for its and others’ advertising purposes. This is in accordance with Meta’s Data Policy, accessible at https://www.facebook.com/about/privacy/. Google Analytics: We utilize Google Analytics, a web analytics service provided by Google, Inc. (“Google”), to gather information regarding your Platform usage. Google Analytics uses cookies to analyze how users interact with our Platform. Other Third-Party Tools: We use other third-party tools for tracking our Platform’s performance. These tools provide insights on errors, app and website performance, and other technical details for Platform and/or Service enhancement.
It is important to note that disabling or altering management settings for any of the aforementioned technologies and/or other tracking, data aggregation, and data analysis technologies may cause certain Platform areas to function improperly.
By visiting, accessing, or using the Service, you acknowledge and consent to Harper MD’s monitoring or tracking of your activities on the Service, and the use of the listed technologies, as well as other tracking, data aggregation, and data analysis technologies.
Additionally, in providing the Service, we and our affiliates and service providers may use your information for numerous purposes, including but not limited to:

We may dispose of or delete such information at any time, except as specified in any other agreement or document executed by us or required by law.
Transactions
In any transaction conducted through the Service (e.g., purchasing or selling products or services), you may be required to provide transaction-relevant information like credit card numbers, billing and shipping addresses, phone numbers, and email addresses. By submitting this information, you agree to its disclosure to third parties facilitating the transaction.
All monetary transactions through the Service occur via an online payment processing application(s) accessed through the Service, currently provided by our third-party online payment processing vendors, such as Stripe.

The Stripe Policies are mentioned for informational purposes only and are not incorporated into this Privacy Policy. Although we have a contract with Stripe, we do not control its operations.
Third Parties
We are not liable for the privacy practices of any third parties, including but not limited to your mobile device manufacturer, and any other third-party mobile applications or websites linked through our Service. These third parties may collect information from or about you. We do not control or assume responsibility for their privacy practices. We encourage you to review the privacy policies of each website and application you visit and use.
Consumer Privacy Rights
Certain state residents may possess additional personal information rights and choices. To learn more about applicable rights as a resident of one of these states and how to exercise them, please refer to our State Privacy Law Addendum. We do not discriminate against you for exercising your privacy rights.
Miscellaneous
We endeavor to employ reasonable physical, technical, and administrative measures to safeguard information under our control. However, it is imperative to keep your Account password secure and confidential. You are responsible for all Account use. If you suspect Account security compromise, promptly notify us according to the “Contacting Us” section below.
While using the Service, you may opt not to provide certain information, but this may limit available features or prevent Service usage altogether. You can also opt out of certain communications (e.g., newsletters, promotions) by emailing your preference. Note that even after opting out, some Service-related communications may still be sent. Currently, we do not respond to web browser “do not track” signals or similar mechanisms indicating a desire not to be tracked or receive interest-based ads. If this changes in the future, the Privacy Policy will be updated to reflect such adjustments.
Harper MD may revise, amend, or otherwise modify this Privacy Policy at any time, with changes posted on the Harper MD website and effective as of the “Last Updated” date. It is your responsibility to review this Privacy Policy whenever visiting, accessing, or using the Service.
